Article 2 – GENERAL PROVISIONS RELATING TO THESE GENERAL TERMS AND CONDITIONS

The General Terms and Conditions of Sale (the "General Terms and Conditions of Sale", or the "GTC") apply exclusively to the online sale of products offered by Mon petit Brésil on the Website.

The GTC are made available to clients on the Site where they can be directly consulted and can also be communicated to them upon simple request by any means.

The GTC are binding on the client who acknowledges, by checking a box or clicking on the button provided for this purpose, having read and accepted them before placing an order. The validation of the order by its confirmation constitutes the buyer's acceptance of the GTC in force on the day of the order, whose preservation and reproduction are ensured by Mon petit Brésil.

 

Article 3 – DESCRIPTION OF PRODUCTS

 

The Site is an online sales site for specialized Brazilian Products (hereinafter the "Product(s)") open to any natural or legal person using the Site (the "Client").

 

The Products presented on the Site each have a description (provided by the supplier or accessible on the manufacturer's website via a link on the Site) mentioning their essential characteristics. Photographs illustrating the products, if any, do not constitute a contractual document. The Product's user manual, if it is an essential element, is available on the Site or sent at the latest upon delivery. The Products comply with the applicable French law requirements.

 

The Client remains responsible for the terms and consequences of their access to the Site, notably via the Internet. This access may involve payment of fees to technical providers such as Internet service providers, which remain their responsibility. Furthermore, the Client must provide and be fully responsible for the equipment necessary to connect to the Site.

 

The Client acknowledges having verified that the computer configuration they use is secure and operational.

 

Article 4 – CREATION OF THE CLIENT AREA

 

The Client must first create their personal client area. Once created, to access it, the Client must identify themselves using their username and their secret, personal, and confidential password. It is the Client's responsibility not to share their username and password in accordance with the provisions of the PERSONAL DATA article of these General Conditions. Each Client commits to maintaining strict confidentiality regarding the data, particularly the username and password, allowing access to their client area, the Client acknowledging being solely responsible for access to the Service through their username and password, except in cases of proven fraud. Each Client also commits to immediately inform Mon petit Brésil in the event of loss, diversion, or fraudulent use of their username and/or password.

 

After creating their personal client area, the Client will receive an email confirming the creation of their client area.

The Client undertakes upon registration to:

  • Provide real, accurate, and up-to-date information at the time of entry in the service registration form, and in particular not to use false names or addresses, or names or addresses without authorization.
  • Keep registration data up to date to ensure their real, accurate, and current nature at all times.

The Client also undertakes not to make available or distribute illegal or reprehensible information (such as defamatory information or identity theft) or harmful information (such as viruses). Otherwise, Mon petit Brésil will be able to suspend or terminate the Client's access to the Site at its sole fault.

Article 5 – ORDERS

Mon petit Brésil strives to guarantee optimal availability of its Products. Product offers are valid within the limits of available stock.

If despite Mon petit Brésil's best efforts, a Product proves to be unavailable after the Client's order, Mon petit Brésil will inform the Client by email or by phone as soon as possible and the Client will have the choice between:

  • the delivery of a Product of equivalent quality and price to the one initially ordered, or
  • the refund of the price of the ordered Product no later than thirty (30) days from the payment of the amounts already paid.

It is agreed that apart from the refund of the price of the unavailable Product, if this option is requested by the Client, Mon petit Brésil is not liable for any cancellation compensation, unless the non-performance of the contract is personally attributable to it.

Except as otherwise stated in these General Conditions and without prejudice to the right of withdrawal provided by applicable law, the Client's orders are firm and final.

When placing an order, the Client must select the chosen Products, add them to their cart by indicating the selected Products and desired quantities. The Client has the option to check the details of their order and its total price, and to return to previous pages to possibly correct the contents of their cart before validating it.

The Client agrees to read the General Terms and Conditions of Sale in effect before accepting them and confirming the terms and any delivery and withdrawal fees prior to payment of their order. Order confirmation implies acceptance of the GTC and forms the contract.

A copy of these General Conditions as accepted by the Client will be sent to the Client by email at the time of order confirmation so that the Client can refer to them.

Contractual information relating to the order (including notably the order number) will be confirmed by email in due time and at the latest at the time of delivery. Mon petit Brésil strongly advises the Client to print and/or archive this order confirmation on a reliable and durable medium as proof. A digital invoice is made available to the Client in the "my account" area or on the email provided when placing the order on the merchant site. Mon petit Brésil also advises the Client to print and/or archive this invoice on a reliable and durable medium as proof.

Any email sent to the Client regarding an order will be sent to the email address the Client uses to log into their client area or the one provided during the order.

Mon petit Brésil reserves the right not to validate the Client's order for any legitimate reason, notably in the case where:

 

  • The Client would not comply with the General Conditions in effect at the time of their order;
  • The Client's order history shows that amounts remain due for previous orders;
  • One of the Client's previous orders is subject to an ongoing dispute;
  • The Client did not respond to a confirmation request for their order sent by Mon petit Brésil.

Mon petit Brésil archives sales contracts of Products in accordance with applicable law. By making a request to the following address info@monpetitbresil.com, Mon petit Brésil will provide the Client with a copy of the contract related to the request.

Any modification of the order by the Client after confirmation of the order is subject to the agreement of Mon petit Brésil.

The information provided by the Client when placing the order (notably name, delivery address, phone number, and email) binds the Client. Thus, Mon petit Brésil cannot be held liable in any way if an error during the order placement prevents or delays delivery/issuance.

The Client declares having full legal capacity allowing them to commit under these General Conditions.

Registration on the merchant site www.monpetitbresil.com is open to capable adults and minors provided that they act under the supervision of the parent or guardian holding parental authority. Under no circumstances is registration authorized on behalf of third parties unless validly authorized to represent them (legal entity for example). Registration is strictly personal to each Client.

In case of breach by the Client of any of the provisions herein, Mon petit Brésil reserves the right to terminate the said Client's account without notice.

Article 6 – PAYMENT METHODS AND SECURITY

The Client expressly acknowledges that any order placed on the Site is an order with an obligation to pay, which requires payment of a price in exchange for the provision of the ordered Product.

In any case, Mon petit Brésil reserves the right to verify the validity of the payment, before shipping the order, by any necessary means.

Mon petit Brésil uses the online payment solution Stripe and Paypal.

Orders can be paid using one of the following payment methods:  

  • Payment by bank card. Payment is made directly on the secure banking servers of Mon petit Brésil's bank; the Client's bank details do not transit through the Site. The bank details provided during payment are protected by an SSL (Secure Socket Layer) encryption process. In this way, these details are not accessible to third parties.

The Client's order is recorded and validated upon acceptance of the payment by the bank.

The Client's account will be debited for the corresponding amount only when (i) the data of the bank card used has been verified and (ii) the debit has been accepted by the bank that issued the bank card.

The inability to debit the amounts due will result in the immediate nullity of the sale.

The bank card may be refused, in particular, if it has expired, if it has reached the maximum spending limit allowed to the Client, or if the entered data is incorrect.

  • Payment by electronic wallet (Paypal type). The Client already has an account on the electronic wallet used by Mon petit Brésil. The Client can use this account and pay for their order securely without sharing their bank details.

If applicable, the order validated by the Client will only be considered effective when the secure bank payment center has approved the transaction.

As part of control procedures, Mon petit Brésil may request from the Client all documents necessary to finalize their order. These documents will not be used for any other purpose.

Article 7 – PAYMENT OF THE PRICE

The price of the Products in effect at the time of the order is indicated in euros including all taxes (TTC) excluding delivery and transport fees. In case of promotion, Mon petit Brésil undertakes to apply the promotional price to any order placed during the advertising period for the promotion.

The price is payable exclusively in euros (€). The price is due in full after order confirmation. The prices offered include discounts and rebates that Mon petit Brésil may grant.

If delivery or transport fees apply, they will be added to the price of the Products and indicated separately before the Client validates the order. The total amount due by the Client and its details are indicated on the order confirmation page.

*Exception for the payment of delivery fees concerning fresh and frozen products sent via the Chronofresh delivery service communicated to the client after order confirmation via a payment link on the stripe platform.

Article 8 – FORMATION OF THE CONTRACT

The contract between Mon petit Brésil and the Client is formed at the moment the Client sends the confirmation of their order.

The Client's attention is particularly drawn to the method of acceptance of the order placed on the Site. When the Client places their order, they must confirm it by the "double-click" technique, that is to say, after selecting Products added to the cart, the Client must check and possibly correct the contents of their cart (identification, quantity of selected products, price, delivery terms and fees) before validating it by clicking on "I validate my delivery", then they acknowledge accepting these GTC before clicking on the "I pay" button, and finally they validate their order after entering their bank details. The "double click" constitutes an electronic signature and is equivalent to a handwritten signature. It constitutes an irrevocable and unconditional acceptance of the order by the Client.

The archiving of communications, order forms, and invoices is ensured by Mon petit Brésil on a reliable and durable medium so as to constitute a faithful and lasting copy. These communications, order forms, and invoices can be produced as proof of the contract. Unless proven otherwise, the data recorded by Mon petit Brésil on the Internet or by phone constitute proof of all transactions between Mon petit Brésil and its Clients.

The order can be resolved by the Client by registered letter with acknowledgment of receipt or by writing on another durable medium in case of:

 

  • delivery of a Product not conforming to the declared characteristics of the Product;
  • delivery exceeding the deadline set in the order form or, failing such a date, within thirty (30) days following the conclusion of the contract, after Mon petit Brésil has been ordered, under the same conditions and without result, to make the delivery within a reasonable additional period;
  • price increase that is not justified by a technical modification of the product imposed by public authorities.

In all these cases, the Customer may demand the refund of the deposit paid increased by interest calculated at the legal rate from the date of receipt of the deposit.

The order may be terminated by Mon petit Brésil in case of:

  • refusal by the buyer to take delivery;
  • non-payment of the price (or balance of the price) at the time of delivery.

Article 9 – RETENTION OF TITLE

Mon petit Brésil remains the exclusive owner of the Products ordered on the Site until full payment of the price, including any shipping costs.

Article 10 – SHIPPING AND DELIVERY

The online sales offers presented on the site are reserved for consumers residing in France or, where applicable, in a member country of the European Union, and for deliveries within these same geographic areas.

Delivery means the transfer to the Customer of physical possession or control of the Product.

Mon petit Brésil offers you different delivery or pickup methods depending on the nature of the product:

  • UPS home delivery

  • Mondial Relay delivery at Relay points

  • Mondial Relay International home delivery and Relay point delivery

  • Chronopost home delivery and Relay point delivery

  • Chronofresh delivery of fresh and frozen products only to home, incurring additional fees mentioned to customers at the time of order

The shipping costs are those specified at the time of order finalization and are accepted upon validation of the order.

Mon petit Brésil commits, in accordance with the delivery deadline indicated on the Site for each Product, to deliver the Products within a maximum period of thirty (30) days after receipt of the order.

Delivery times are announced in business days on the Site at the time of order. These times include order preparation and shipping as well as the time expected by the carrier.

Mon petit Brésil commits to shipping the Products within the announced timeframes, provided that the payment for the order has not been previously refused. If one or more Products cannot be delivered within the initially announced timeframe, Mon petit Brésil will send an email indicating the new delivery date to the Customer.

Products will be delivered to the address provided by the Customer. It is therefore their responsibility to verify this address. Mon petit Brésil cannot be held liable if the address is incorrect.

Upon delivery, a receipt may be requested to be signed. No delivery will be made to a PO box.

It is the Customer's responsibility to verify that the Products are compliant and that the package is sealed and undamaged. Any defect must be reported on the delivery note. Without this, no claim will be accepted.

Goods travel at the recipient's risk. The customer has 48 hours to make any reservations with customer service in case of missing or damaged items.

In case of delivery refusal, Mon petit Brésil reserves the right to refund the order deducting the shipping fees charged by the carrier.

In case of damaged or missing products, the customer must contact Customer Service within 48 hours of receipt, with a description of the problem, the order reference, and photos. Any return, outside the right of withdrawal, requires prior agreement.

📦 DELIVERY CONDITIONS – SPECIAL POLICY MON PETIT BRÉSIL

  1. Home delivery by UPS – Case of delivery impossibility In case of impossibility to deliver to the address provided by the customer (recipient absent, intercom not working, access denied, etc.), or in case of incorrect or incomplete contact details (address, phone, email), the package is automatically redirected to the nearest UPS pickup point. The customer is informed by email and/or SMS according to the information provided during the order.

If the customer does not pick up their package within the time allowed by UPS, it is returned to our warehouse. In this case:

  • The customer may request a reshipment of the order: reshipping costs will be borne by them, even if the first delivery was free.

  • The customer may also request a partial refund, excluding the initial delivery fees.

These provisions comply with Article L221-15 of the Consumer Code (consumer error) and Article L221-24 regarding the non-obligation to refund shipping costs in case of return not attributable to the seller.

  1. Deliveries to relay points (Chronopost Shop2Shop, UPS Access Point) When a delivery is made to a relay point, the customer is notified of the availability of their package by email and/or SMS based on the contact details they provided when placing the order.

If this information is incorrect or inaccessible, the notification may fail. In this case:

  • The package remains available at the relay point for a limited period (usually 7 calendar days).

  • If the package is not picked up on time, it is returned to Mon Petit Brésil.

The customer may then:

  • Request a reshipment, with costs borne by them.

  • Or a partial refund, excluding delivery fees.

The customer remains fully responsible for the information they provide when placing the order (Article L221-15 of the Consumer Code).

  1. Deliveries outside the European Union – Incoterm DAP For any delivery to a country outside the European Union, Mon Petit Brésil applies the Incoterm DAP – Delivered At Place.

This means that:

  • The package is delivered to the address provided by the customer.

  • Import taxes, customs duties or handling fees are not included in the amount paid to Mon Petit Brésil.

  • The customer is responsible for paying these fees to the carrier or customs authorities of their country.

In case of refusal of the package or return due to non-payment of these fees, no full refund can be claimed. These conditions comply with the practices of international trade governed by the Incoterms of the International Chamber of Commerce (ICC).

Article 11 – RIGHT OF WITHDRAWAL

If a delivered Product does not fully satisfy the Customer, the latter may return it to Mon petit Brésil. The Customer will have fourteen (14) days to do so from the date of receipt of the order.

In accordance with Article L.221-21 of the Consumer Code and in order to implement this right of withdrawal under the conditions of Articles L. 221-18 and following of the Consumer Code, the Customer is invited to fill out the standard withdrawal form by clicking on the following link https://entreprendre.service-public.fr/vosdroits/R38397.

Mon petit Brésil will send an acknowledgment of receipt of the Customer's withdrawal request by email.

If applicable, the Customer may exercise their right of withdrawal by notifying the following information to Mon petit Brésil:

  • name, geographic address, phone number and email address ;
  • withdrawal decision by means of an unequivocal statement (for example, letter sent by post, fax, or email provided these contact details are available and thus appear on the standard withdrawal form). The Customer may use the withdrawal form template but it is not mandatory.

Return costs are borne by the Customer, except if the item cannot normally be returned by Post, in which case Mon petit Brésil will collect the Product at its own expense.

The exceptions of Article L.221-28 of the Consumer Code apply and prevent the exercise of the right of withdrawal, notably if the order consists of a contract:

  • for the supply of services fully performed before the end of the withdrawal period and whose performance has begun after the consumer's express prior consent and express waiver of their right of withdrawal;
  • for the supply of goods or services whose price depends on fluctuations in the financial market beyond the professional's control and likely to occur during the withdrawal period;
  • for the supply of goods made according to the consumer's specifications or clearly personalized;
  • for the supply of goods liable to deteriorate or expire rapidly ;
  • for the supply of goods which have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection;
  • for the supply of goods which, after delivery and by their nature, are inseparably mixed with other items;
  • for the supply of alcoholic beverages where delivery is postponed beyond thirty (30) days and the agreed value at the conclusion of the contract depends on market fluctuations beyond the professional's control;
  • for urgent maintenance or repair work to be carried out at the consumer's home and expressly requested by them, limited to the spare parts and work strictly necessary to meet the urgency;
  • for the supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery;
  • for the supply of a newspaper, periodical, or magazine, except for subscription contracts to these publications;
  • concluded during a public auction;
  • for the provision of accommodation services, other than residential accommodation, transport of goods, car rentals, catering, or leisure activities that must be provided on a specific date or during a specific period;
  • for the supply of digital content not provided on a tangible medium whose performance has begun after the consumer's express prior consent and express waiver of their right of withdrawal.

The Returned Product must be in its original packaging, in perfect condition, clean for resale, unused, and with all possible accessories.

In addition to the returned Product, the return package must also contain a letter specifying the exact (name, first name, address) and complete contact details of the Client as well as the order number, and the original purchase invoice.

Mon petit Brésil will refund the Client the amount of the Product within fourteen (14) days from the receipt of the Product and all elements allowing the implementation of the Client's refund. This refund may be made by the same payment method used by the Client. In this respect, the Client who paid for their order in the form of credits / gift vouchers may be refunded by credits / gift vouchers according to the will of Mon petit Brésil.

By accepting these General Terms and Conditions of Sale, the Client expressly acknowledges having been informed of the withdrawal procedures.

Article 12 – Disputes

This contract is subject to French law and limited to Metropolitan France.
Mon petit Brésil's liability will, in any case, be limited to the amount of the order and cannot be held responsible for simple errors or omissions that may have remained despite all precautions taken in the presentation of the products.
In case of dispute, the client will first contact the company to obtain an amicable solution. Failing that, disputes will be brought before the competent Courts.

Article 13 – CUSTOMER SERVICE

The Client can contact Mon petit Brésil:

  • At the following number 07 67 43 18 25 on the following days and hours From Tuesday to Saturday from 12PM to 6:30PM.
  • By email by contacting info@monpetitbresil.com by indicating their name, phone number, the subject of their request and the number of the order concerned.

Article 14 – INTELLECTUAL PROPERTY AND SITE USAGE LICENSE

Mon petit Brésil is the sole holder of all elements present on the Site, including but not limited to, all texts, files, animated or non-animated images, photographs, videos, logos, drawings, models, software, trademarks, visual identity, database, Site structure and all other intellectual property elements and other data or information (hereinafter, the " Elements ") which are protected by French and international laws and regulations relating notably to intellectual property.

Consequently, none of the Site Elements may be modified, reproduced, copied, duplicated, sold, resold, transmitted, published, communicated, distributed, broadcast, represented, stored, used, rented, or exploited in any other way, free of charge or for a fee, by a Client or a third party, regardless of the means and/or media used, whether known or unknown to date, without the prior express and written authorization of Mon petit Brésil on a case-by-case basis, and the Client is solely responsible for any unauthorized use and/or exploitation.

Mon petit Brésil is the sole holder of all elements present on the Site, including but not limited to all texts, files, animated or not, photographs, videos, logos, drawings, models, software, trademarks, visual identity, database, Site structure, and all other intellectual property elements and other data or information (hereinafter, the "Elements") which are protected by French and international laws and regulations relating notably to intellectual property.

Consequently, none of the Site Elements may be modified, reproduced, copied, duplicated, sold, resold, transmitted, published, communicated, distributed, broadcast, represented, stored, used, rented, or exploited in any other way, free of charge or for a fee, by a Client or a third party, regardless of the means and/or media used, whether known or unknown to date, without the prior express and written authorization of Mon petit Brésil on a case-by-case basis, and the Client is solely responsible for any unauthorized use and/or exploitation.

Furthermore, it is specified that Mon petit Brésil is not the owner of the content posted online by Clients, for which they remain fully responsible and guarantee the Company against any claims in this regard. Clients grant Mon petit Brésil a non-exclusive, transferable, sublicensable, free, and worldwide license to use the intellectual property content they publish on the Site, for the entire duration of protection of these contents.

Mon petit Brésil reserves the right to take all legal action against persons who have not respected the prohibitions contained in this article.

ARTICLE 15 – LIABILITY AND WARRANTY

Mon petit Brésil cannot be held responsible for non-performance of the contract due to the Client or because of an event qualified as force majeure by the competent courts or due to unforeseeable and insurmountable acts of any third party to these terms.

The Client acknowledges that the characteristics and constraints of the Internet do not allow guaranteeing the security, availability, and integrity of data transmissions over the Internet. Thus, Mon petit Brésil does not guarantee that the Site and its services will operate without interruption or malfunction. In particular, their operation may be temporarily interrupted for maintenance, updates, or technical improvements, or to evolve their content and/or presentation.

Mon petit Brésil cannot be held responsible for the use made of the Site and its services by Clients in violation of these General Conditions and for any direct or indirect damages that such use may cause to a Client or a third party. In particular, Mon petit Brésil cannot be held responsible for false statements made by a Client and for their behavior towards third parties. In the event that Mon petit Brésil’s liability is sought due to such behavior of one of its Clients, the latter agrees to indemnify Mon petit Brésil against any judgment pronounced against it as well as to reimburse Mon petit Brésil for all costs, including attorney fees, incurred for its defense.

 

Regardless of any additional contractual warranty (commercial warranty) that may be granted, the Products benefit from the legal warranty of conformity provided for in articles L. 217-4 and following of the Consumer Code (notably L. 217-4 to L. 217-14 of the Consumer Code), and from the warranty against hidden defects provided for in articles 1641 to 1649 of the Civil Code.

When you act within the framework of the legal warranty of conformity:

  • you benefit from a period of two (2) years from the delivery of the good to take action:
  • you may choose between repair or replacement of the good, subject to the cost conditions provided by article L. 217-9 of the Consumer Code;
  • you are exempt from proving the existence of the non-conformity defect of the good during the twenty-four (24) months following the delivery of the good (except for used goods).

You may decide to implement the warranty against hidden defects of the sold item within the meaning of article 1641 of the Civil Code. In this case, you may choose between rescission of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.

Reproduction of articles L. 217-4, L. 217-5, L. 217-7, L. 217-9, and L. 217-12 of the Consumer Code, articles 1641, 1644, and the first paragraph of article 1648 of the Civil Code, as in force at the date of these General Terms and Conditions of Sale:

Art. L.217-4 of the Consumer Code:

« The seller delivers a good that complies with the contract and is liable for non-conformity defects existing at the time of delivery. The seller is also liable for non-conformity defects resulting from packaging, assembly instructions, or installation when this has been charged to them by the contract or carried out under their responsibility.»

Art. L.217-5 of the Consumer Code:

« The good complies with the contract:

1° If it is suitable for the usual use expected of a similar good and, where applicable:

- if it corresponds to the description given by the seller and possesses the qualities that the seller presented to the buyer in the form of a sample or model;

- if it has the qualities that a buyer can legitimately expect in view of public statements made by the seller, the producer, or their representative, notably in advertising or labeling;

2° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, made known to the seller and accepted by the latter.»

Art. L.217-7 of the Consumer Code:

« Non-conformity defects that appear within twenty-four months from the delivery of the good are presumed to have existed at the time of delivery, unless proven otherwise.

For used goods, this period is set at six months.

The seller may contest this presumption if it is not compatible with the nature of the good or the claimed non-conformity.»

Art. L.217-9 of the Consumer Code:

« In case of non-conformity, the buyer chooses between repair and replacement of the good. It is reminded that seeking amicable solutions prior to any possible legal action does not interrupt the time limits for legal warranty claims nor the duration of any contractual warranty.

Mon petit Brésil cannot be held responsible for non-performance of the contract due to the Client or because of an event qualified as force majeure by the competent courts or due to unforeseeable and insurmountable acts of any third party to these terms.

Mon petit Brésil cannot be held responsible for information imported, stored, and/or published on the Site by Clients. Mon petit Brésil cannot be held liable for any information published by a Client on the Site and for direct or indirect damages that such use could cause to a third party, the Client who originated the publication remaining solely responsible in this regard.

 

The Client acknowledges that the characteristics and constraints of the Internet do not allow guaranteeing the security, availability, and integrity of data transmissions over the Internet. Thus, Mon petit Brésil does not guarantee that the Site and its services will operate without interruption or malfunction. In particular, their operation may be temporarily interrupted for maintenance, updates, or technical improvements, or to evolve their content and/or presentation.

 

Mon petit Brésil cannot be held responsible for the use made of the Site and its services by Clients in violation of these General Conditions and for any direct or indirect damages that such use may cause to a Client or a third party. In particular, Mon petit Brésil cannot be held responsible for false statements made by a Client and for their behavior towards third parties. In the event that Mon petit Brésil’s liability is sought due to such behavior of one of its Clients, the latter agrees to indemnify Mon petit Brésil against any judgment pronounced against it as well as to reimburse Mon petit Brésil for all costs, including attorney fees, incurred for its defense.

 

The Client is solely responsible for all content they upload on the Site, expressly declaring that they hold all rights thereto, and guarantees to Mon petit Brésil that they do not upload content violating third-party rights, notably intellectual property rights, or constituting an infringement on individuals (notably defamation, insults, slander, etc.), privacy rights, an infringement on public order and good morals (notably, advocacy of crimes against humanity, incitement to racial hatred, child pornography, etc.). In case of violation of applicable laws, good morals, or these General Conditions, Mon petit Brésil may exclude Clients who have committed such offenses by right and delete information and links to such contentious content. Mon petit Brésil is qualified as a host regarding content uploaded by third parties. As such, it is reminded that Mon petit Brésil has no general obligation to monitor content transmitted or stored via the Site. In the event that Mon petit Brésil’s liability is sought due to content uploaded by the Client, the latter agrees to indemnify Mon petit Brésil against any judgment pronounced against it as well as to reimburse Mon petit Brésil for all costs, notably attorney fees, incurred for its defense.

 

Regardless of any additional contractual warranty (commercial warranty) that may be granted, the Products benefit from the legal warranty of conformity provided for in articles L. 217-4 and following of the Consumer Code (notably L. 217-4 to L. 217-14 of the Consumer Code), and from the warranty against hidden defects provided for in articles 1641 to 1649 of the Civil Code.

When you act within the framework of the legal warranty of conformity:

  • you benefit from a period of two (2) years from the delivery of the good to take action:
  • you may choose between repair or replacement of the good, subject to the cost conditions provided by article L. 217-9 of the Consumer Code;
  • you are exempt from proving the existence of the non-conformity defect of the good during the twenty-four (24) months following the delivery of the good (except for used goods).

You may decide to implement the warranty against hidden defects of the sold item within the meaning of article 1641 of the Civil Code. In this case, you may choose between rescission of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.

Reproduction of articles L. 217-4, L. 217-5, L. 217-7, L. 217-9 and L. 217-12 of the Consumer Code, articles 1641, 1644 and the first paragraph of article 1648 of the Civil Code, as in force at the date of these General Conditions:

Art. L.217-4 of the Consumer Code:

« The seller delivers a good that complies with the contract and is liable for non-conformity defects existing at the time of delivery. The seller is also liable for non-conformity defects resulting from packaging, assembly instructions, or installation when this has been charged to them by the contract or carried out under their responsibility.»

Art. L.217-5 of the Consumer Code:

« The good complies with the contract:

1° If it is suitable for the usual use expected of a similar good and, where applicable:

- if it corresponds to the description given by the seller and possesses the qualities that the seller presented to the buyer in the form of a sample or model;

- if it has the qualities that a buyer can legitimately expect in view of public statements made by the seller, the producer, or their representative, notably in advertising or labeling;

2° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, made known to the seller and accepted by the latter.»

Art. L.217-7 of the Consumer Code:

« Non-conformity defects that appear within twenty-four months from the delivery of the good are presumed to have existed at the time of delivery, unless proven otherwise.

For used goods, this period is set at six months.

The seller may contest this presumption if it is not compatible with the nature of the good or the claimed non-conformity.»

Art. L.217-9 of the Consumer Code:

« In case of non-conformity, the buyer chooses between repair and replacement of the good. However, the seller may not proceed according to the buyer's choice if this choice results in a manifestly disproportionate cost compared to the other option, considering the value of the good or the importance of the defect. The seller is then required to proceed, unless impossible, according to the option not chosen by the buyer ».

After-sales services performed by Mon petit Brésil that are not covered by the commercial warranty are subject to a contract, a copy of which is given to the Client.

If the Client uses these links, they will leave the Site and agree to use the third-party sites at their own risk or, if applicable, in accordance with the conditions governing them.

The Client acknowledges that Mon petit Brésil neither controls nor contributes in any way to the development of the terms of use and/or content applicable to or appearing on these third-party sites.

Consequently, Mon petit Brésil cannot be held responsible in any way for these hyperlinks.

Furthermore, the Client acknowledges that Mon petit Brésil cannot endorse, guarantee, or assume responsibility for all or part of the terms of use and/or content of these third-party sites.

ARTICLE 19 – GENERAL PROVISIONS

ENTIRE AGREEMENT OF THE PARTIES

These General Conditions constitute a contract governing the relationship between the Client and Mon petit Brésil. They constitute the entirety of the rights and obligations of the Company and Mon petit Brésil relating to their subject matter. If one or more provisions of these General Conditions are declared null under a law, regulation, or following a final decision of a competent jurisdiction, the other provisions shall retain their full force and effect. Furthermore, the fact that one of the parties to these General Conditions does not invoke a breach by the other party of any of the provisions of these General Conditions shall not be interpreted as a waiver on its part to invoke such a breach in the future.

CHANGES TO THE CONDITIONS

Mon petit Brésil reserves the right to modify at any time and without notice the content of the Site or the services available on it, and/or to temporarily or permanently cease operating all or part of the Site.
